MCCONNELL DOWELL SOUTH EAST ASIA PRIVATE LIMITED is seeking an experienced Commercial Manager Precontracts to be based in Singapore for our civil marine works tendering activities for the SEA region.
Key Responsibilities- Reporting to the Regional Commercial Manager SEA, the primary objective is to oversee and ensure the efficient and effective management of the commercial and contractual activities undertaken during the new business and tendering stages for allocated tenders, including:
- Analyzing and identifying commercial, business, and contractual risks that may occur in projects during the pre-contract tendering and joint venture development stage.
- Conducting tender commercial risk reviews and ensuring compliance with the Company's procedures and corporate governance requirements.
- Engaging with Bid Managers, New Business & Strategy, and other relevant personnel that participate in tendering exercises, in relation to commercial strategies and frameworks involving partner selection and tenders undertaken by the Business.
- Working with the New Business and Strategy Team to develop appropriate strategic, commercial, and contractual responses to tenders.
- Developing key contractual arrangements with designers in consultation with Regional Commercial Manager SEA and Regional Engineering Manager SEA.
- Collaborating with team members to strategize, develop, and negotiate key contractual arrangements, frameworks, and terms with business partners (e.g., joint venture/consortium partners).
- Ensuring effective and consistent implementation of the Company's commercial policies and procedures in all pre-contracts activities.
- Ensuring compliance with Tender Risk Management Procedures and driving completion of due diligence activities.
- Assisting and supporting the New Business & Strategy Team in developing strategic, commercial, and contractual responses to Tenders, Expressions of Interest, and Joint Venture prospects.
- Developing contractual frameworks with key partners, including Joint Venture and Design partners.
- Conducting tender reviews and ensuring compliance with Commercial Operating Standards and Policies, such as the Limits of Authority and the Head Contract Commercial Limits.
- Liaising with Group Legal Counsel in relation to the provision of and requirements in relation to parent company guarantees and other legal matters relevant to pre-contract works.
- Assisting the Regional Commercial Manager SEA with tender review processes and attendance at all stages of the review process for allocated tenders. Participating in external audits and company Peer Review processes.
- Where requested, assisting in the review of monthly project financial reports.
- Where required by the Regional Commercial Manager SEA, assisting in dealing with project commercial issues where supplemental support is requested by the project team.
- Providing feedback on lessons learned on tender and project commercial issues that can be utilized for continuous improvement throughout the business.
- Any other duties as may reasonably be required by the Company.
To be considered for this role, you will have:
- Relevant tertiary qualifications.
- A sound understanding of construction contracts and ancillary contracts, such as Joint Venture Agreements.
- Demonstrated ability to analyze contractual/legal issues and provide solutions through appropriate problem-solving techniques.
- Sound commercial acumen accompanied by proven negotiation and inter-relationship skills.
- Able to quickly grasp concepts and apply innovative options to the status quo.
- Clear and definitive communication – written and verbal, accompanied by competent presentation ability.
- Tasks are to be completed on time and to a high standard.
