Duties

The incumbent performs a variety of activities under the supervision of OCIG attorneys related to providing legal assistance for functions carried out by OCIG which primarily include researching and writing on health law and health care topics.

Assists in the review of case materials, including court records, medical records, and other documents related to health care, to identify the relevant factual and legal issues necessary to prepare legal documents including, pleadings and legal memorandum. Assists attorneys in preparing documents to be filed with various courts and administrative bodies.

Assists attorneys in the research of legal concepts related to health care or health law, applies facts of a case to relevant law, and prepares written memoranda that summarize the research. Researches OCIG's prepared legal materials, Federal court decisions, legislative histories, Centers for Medicare and Medicaid Services regulations and departmental program materials, and other similar materials.

Assists attorneys in reviewing various legal documents related to health care or health law and flags problem cases or documents that require the immediate attention of an attorney. If supporting documents or information is incomplete, contacts appropriate individual to obtain necessary documentation or information.

Assists attorneys in the preparation of legal memoranda related to health care or health law, letters, and other legal documents and ensures that legal documents prepared are in the correct format and contain required exhibits, attachments, and other necessary materials.

Participates in discussions, meetings, and conferences to gather facts, develop informative and constructive relationships, and secure and provide information.

Tracks cases internally and with other agencies with regard to court deadlines. Assists in responding to and initiating status inquiries.

Compiles facts and evidence, history and background of laws and cases related to health care or health law, citing pertinent law and recommending the applicability of selected cases as precedent. Resolves conflicts between apparently conflicting cases, determining whether courts have ruled on particular matters, existing decisions have been changed, modified, overruled, or reversed. Prepares appropriate documentation for forwarding to the appropriate federal or state courts, as well as administrative tribunals.

Performs other duties as assigned.
